This document (General Conditions of Sale) defines the conditions applicable to sales concluded between on the one hand people of the “Individual” and “Professional” type making a purchase via the Stelfia.com Website, hereinafter referred to as “the Client” and on the other hand the company Stelfia Sàrl, hereinafter referred to as “Stelfia”, Professionals are required to contact customer service and do not benefit from all the conditions applicable to individuals and in particular Article 6.

 

Art. 1 – SCOPE OF APPLICATION

The general conditions of sale (hereinafter referred to as General Conditions of Sale) apply to all purchase transactions concluded with Stelfia, as well as in the online store by customers domiciled or established in Switzerland. These General Terms and Conditions are not applicable to contracts between Stelfia and its commercial partners (such as suppliers). Art. 4 – ORDERS

4.1 Orders can be placed on the website www.stelfia.com or in store.

4.2 French is the one and only language offered for the conclusion of the sales contract.

4.3 Product characteristics are indicated on each product page. 4.5 Any order placed on www.stelfia.com does not necessarily require the creation of a customer account. Access to the customer account is via the username and password indicated when creating the customer account. Stelfia cannot be held responsible for any action carried out via or on your customer account by a third party to whom you have communicated your identifiers or who has had access to your identifiers or to your customer account following a fault or negligence being attributable to you.

4.6 The checkbox on the acknowledgment and acceptance of the T&Cs as well as the click on the “ORDER” button validates the order. These actions are equivalent to an “electronic signature” and a handwritten signature. 4.7 The customer order number is given for information purposes only and does not in any way correspond to the invoice number. The invoice is communicated to the customer by email. The customer is strongly advised to keep this invoice.

4.8 Orders placed on www.stelfia.com may be automatically canceled if payment is not received. This cancellation period is extended to 5 days in the event of payment by bank transfer. Stelfia reserves the right not to validate your order for any legitimate reason, in particular in the event that it does not comply with these General Terms and Conditions or in the event that several serious and consistent elements would give rise to a suspicion of fraud on your order.

4.9 The customer can cancel his order as long as it is not transmitted to the logistics services, the transmission to the logistics services corresponds to the sending of the email specifying that the order has been shipped. When the order is prepared, cancellation can only be done by refusal by the customer when presenting the package. Concerning professionals, no unilateral cancellation of their order will be accepted without the prior agreement of Stelfia.

4.10 The information communicated by the customer when placing the order (in particular name and delivery address) binds the latter, therefore, Stelfia cannot be held responsible in any way in the event of an error during the placement of the order would cause a delay or prevention of delivery.

4.11 The customer has the possibility of placing an order for a product not yet available for delivery, this is indicated on the product sheet as a “pre-order” product. The customer then pays the sale price and will be delivered from the date indicated on the product sheet. The product is reserved in the customer's name during the waiting time for delivery.

4.12 The rental contract is subject to acceptance by our financial partner. Any refusal results in its cancellation and cannot engage the liability of Stelfia.

4.13 For any order subject to financing, it is imperative that the customer follows the guidelines issued by Swissbilling.

4.14 The Stelfia company undertakes not to store bank card data on the website.

 

Art. 5 – PRICE

5.1 All prices of products and services offered for sale on the site www.stelfia.com are expressed in CHF, all taxes included and excluding shipping costs. They are likely to vary in the event of a change in the VAT rate.

5.2 Stelfia reserves the right to modify its prices at any time but undertakes to apply the prices in force when the order is registered subject to the availability of the products on that date.

5.3 The products ordered remain the property of Stelfia until full payment of the price. However, from receipt of the order by the customer or his representative, the risks of the goods delivered are transferred to the customer.

5.4 The amount of delivery costs is calculated automatically according to each order, it appears on the summary of your order, before its final recording.

5.5 For any sale made outside Switzerland, the Customer assumes sole responsibility and liability for payment of all import duties and taxes that may be applicable.

 

Art. 6 – COMPLIANCE

6.1 The customer is required to check the conformity of the delivered goods before signing any delivery document. If an anomaly is noted, the customer must indicate his reservations, followed by his signature, directly on the delivery document. 6.2 Stelfia undertakes to reimburse or exchange products which do not conform to the customer's order. The customer must then send his request in writing via the contact form on the website www.stelfia.com or by registered mail with acknowledgment of receipt to Stelfia within 15 days following the delivery date. This complaint relating to the non-conformity of a product in relation to its order must be accompanied by the customer's choice between reimbursement or exchange. Any complaint made outside this deadline cannot be accepted. Any exchange request by the customer must comply with the procedure defined in article 8.

6.3 In the cases referred to in this article 6.2, the return of products will only be accepted for products returned complete, in their original condition (original packaging, instructions, accessories) and unused. In these same cases, the return costs will be reimbursed by Stelfia.

6.4 In accordance with the provisions in force, Stelfia will not accept the return of consumables when they have been unsealed by the customer. Consumables correspond to: oils, cleaning products, anti-theft devices, spare parts, wearing parts* sold by Stelfia. The user is solely responsible for the installation and use of spare and worn parts*, once unpacked the part will not be returned or exchanged, regardless of its useful life. use or life. Art. 7 – RESERVATION OF OWNERSHIP

The items remain the property of Stelfia until full payment of all claims arising from or in connection with the purchase made. The customer authorizes Stelfia to make, at the customer's expense, the corresponding entry in the register of reservations of title.

 

Art. 8 – CONDITIONS AND DEADLINES FOR EXERCISING THE RIGHT OF WITHDRAWAL

The customer is responsible for the return costs. Shipping costs (actual cost) are not eligible for reimbursement. Under common law, goods travel at the customer's risk. Stelfia recommends that the customer take all necessary insurance to cover these risks as well as all precautions to protect the product. The customer's reimbursement will be made by crediting the bank account within a maximum period of 30 days following the date on which the right of withdrawal was exercised. The customer has 14 days from delivery of their order to return any item that does not suit them. Art. 9 – PAYMENT

9.1 Payment by invoice / Payment in several installments.

Art. 10 – DELIVERY AND TRANSPORT

10.1 Delivery is made either by direct delivery to the customer in store or by delivery to the address indicated on the order. Stelfia reserves the right to choose the carrier.

10.2 In the case of provision of the order to the customer by our carriers, if the order is not claimed by the customer, it will be returned to Stelfia, the return costs being the responsibility of the customer. This return causes the cancellation of the contract and the reimbursement of the sums paid by the customer, less return costs and possible damages.

10.3 Stelfia is entitled to make partial deliveries. Additional deliveries are made upon receipt of the goods. If Stelfia mentions delivery or availability times, these are indicative times without commitment. If a delivery or availability deadline indicated by Stelfia is not respected, the customer is entitled, at the expiration of an additional period of 10 days that he sets in writing, to withdraw from the contract for regarding items that have not been delivered or made available. Any amounts already paid are in this case refunded to the customer. The customer cannot assert any other claim. If the customer decides to have the items delivered, he or she will be informed by email at the time the items are entrusted to the carrier for delivery. Stelfia reserves the right to choose the carrier.

10.4 The risks of the item pass to the customer upon delivery of the items to the carrier. The items are insured against damage occurring during transport, to the extent that the value of the items exceeds the maximum limit of the carrier's liability. Without limiting the generality of the foregoing, the customer undertakes in particular to:

11.3 Special conditions for product maintenance

The customer is required to follow the conditions, terms and instructions for storage and maintenance of the products, their components and spare parts, as indicated in the user manual.

The customer is prohibited from using the products and undertakes to contact Stelfia after-sales service in the event of detection of any defect and/or anomaly during control and maintenance operations on the Products, following in particular the indications provided in the User Manual.

 

Art. 12 – LIMITATION OF LIABILITY

Stelfia cannot be held responsible, in any capacity and on any legal basis whatsoever, for any harm, damage, material and/or bodily, direct or indirect, occurring following storage, use and/or maintenance of products in conditions contrary to and/or insufficient in relation to the terms of this article 11 and more generally to the conditions, terms, limits and instructions for use and safety indicated in the user manual.

 

 

Art. 13 – GUARANTEE AND LIABILITY

13.1 Stelfia grants customers a 2 year warranty (and one year on the battery) for new models, from the first delivery or collection of the item for defects that result from faulty material or workmanship . In such a case, the customer is not entitled to reimbursement of repair costs. The customer's warranty right expires in the event of technical intervention and defects resulting from improper handling, excessive stress, inappropriate use, external intervention (damage due to humidity, contact with liquid, blows, etc.) or failure to follow the manufacturer's operating and maintenance instructions.

13.3 In the event of delivery of an equivalent, defect-free replacement item, the warranty period is again 2 years (and one year on the battery) from the moment the customer is notified of the availability of the item. replacement item. In the event of repair, no warranty will be renewed, Stelfia only guarantees the spare parts used in this case. The customer's warranty rights relating to the entire item remain intact during the warranty period of 2 years from the first delivery or first collection of the item (see section 13.1).

The risks and costs of all transport, for example transport to the chosen Stelfia premises or transport back to the customer are the responsibility of the customer. Art. 14 – INTELLECTUAL PROPERTY
